Please read these Terms of Service carefully before accessing or using our Site or services. This Terms of Service applies to all Tabehako Site visitors and users of our Site or services and by visiting or using the Site, you agree to be bound by this Terms of Service. If you don’t agree with any term or condition in this Terms of Service, please don’t use our Site or any of our services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Use of the Site for any illegal or unauthorized purpose is strictly prohibited.

Tabehako reserves the right to change the following Terms of Service, as well as any pricing on our Site at any time without notice. Please read and review our Terms of Service regularly to ensure you are up to date with our policies.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service. You are responsible for reading through our Terms of Service and Privacy Policy prior to ordering. 

Tabehako provides allergen information for included items on our Site, based on the ingredient list of the item at the point of writing. Please note that this information does not mean that it is free from cross-contamination, as these items may be produced in factories with products that do contain allergens. Please assess your own situation in regards to any allergies, and refrain from using our services if cross-contamination may affect your health.

The Ministry of Agriculture, Forestry, and Fishery has compiled a list of 27 common allergen ingredients, of which only 7 are required to be indicated on food packaging. Therefore we may only able to provide up until the seven common allergens in most cases. We cannot guarantee that these are the only allergens present for the specified item.

  • Twenty recommended allergens (not always included): Abalone, apple, banana, beef, cashew nuts, chicken, gelatin, kiwi, mackerel, matsutake mushroom, orange, peach, pork, salmon, salmon roe, sesame, soy, squid, walnut, yam.

Japan is home to more snacks than you can enjoy in a lifetime, but unfortunately most of these indulgements are not halal. All Tabehako products are free from non-halal ingredients.

Please note that not all of our products are halal-certified, as there are very few Japanese products with halal certification. Instead, we handpick everything and check all ingredients and confirm with the manufacturer when needed. This also means that if the manufacturer decides to change the ingredients of a certain product, we might not offer these products in the future again if non-halal ingredients are added in the process.

Please note that our selected items may be produced in factories that also produce non-halal products. Please do not use our services if you only consume products that are halal certified. 

By purchasing any subscription, you acknowledge that the full amount for your subscription has to be paid in advance. Your subscription will be cancelled automatically, and you will have to repurchase in case you wish to extend your subscription with Tabehako. While you can request cancellation of your subscription during your subscription period without a cancellation charge, Tabehako will not provide any refund for the remainder of the purchased subscription period in any case.

In case of mistaken orders, you can request a cancellation of your subscription or order up until two hours after placing your order. Please do so by contacting us via our contact form. Tabehako is not responsible for any additional purchases made due to human error or incompetence during and/or post-purchase. We are therefore unable to make any changes or cancellations to your order after two hours after placing your order.

For our monthly Tabehako boxes, you can order the box for the upcoming month until the 25th of the preceding month. You will receive the box in the first week of the upcoming month, unless it’s a special order (e.g. custom order, time-limited order etc.). You will receive a shipment notification once your box has shipped.

As we ship directly from Japan, delivery time may take two to three weeks, depending on your country’s import procedure and busier holiday periods. Please note that due to local customs or postal service delays shipping may take longer in some cases.

Once a package is shipped Tabehako has no control over it. Please note that delivery times listed above are only estimations. Tabehako is not responsible for any delays caused by the courier,, especially during high-volume periods. Tabehako can never guarantee a delivery date. We are not responsible for any package that comes back as undeliverable.

If you are not home to accept your package, the carrier will assess whether it is safe to leave. You may have to pick up your package from a collection pick-up point or local post office branch in some cases.

Tabehako is not responsible for lost or stolen packages. Tabehako is not liable for missing parcels due to errors on the customer or carrier’s part. Tabehako is not responsible if your order is not received, missing or abandoned by the courier.

During busy sale periods or new collection launches, your order may not always be delivered within the specified delivery timeframes. We are unable to provide compensation to customers for any unexpected delays with your delivery once the item has been despatched from our warehouse. These delays are out of the control of Tabehako and no compensation will be provided.

Tabehako operates on a no returns policy, due to hygienic and safety reasons.

In the event of a missing or extremely damaged item, please contact us via our contact form with your full name and order details within 48 hours after you receive your box). Unless extremely crumbled, inedible, or missing, we do not provide compensation for edible items broken during shipment. Please note that in the rare case of monetary compensation, we will withhold €15 (Euro) to cover for shipping and processing costs. 

Any missing or damaged items must be reported within 48 hours after you receive your box to qualify for a replacement. If the missing product is still available, Tabehako may ship the missing product or process a (partial) refund depending on assessment of the situation. In case of reshipment, if the missing product is out of stock, you may receive a replacement that is similar in nature, as assessed by Tabehako. Damaged items can only be replaced in case of non-edible products.

You are required to supplement the below information to be eligible for replacement within 48 hours after delivery.

• Pictures of all sides of the box
• Picture of all items received (all items in a single picture)
• Detailed pictures of the damaged product (in case of damage)

Tabehako may deliver notice to you by means of e-mail, a general notice on this Site, or by other reliable method.

Tabehako will use your email address or contact information to update you on the status of your order, or any matter that Tabehako deems important. Tabehako will not send you promotional information or newsletters if you have opted out of the option of receiving promotional information or newsletters. You can always update your email preferences at any moment.

Please note taxes and duties may be charged for international orders. The prices within the online store do not include relevant overseas duties and other customs charges you may incur. These costs are imposed by your local customs office and are outside of our control. Please familiarize yourself with your country’s customs charges and levies prior to placing an order. Tabehako is not responsible if customers are not notified by their country’s postal authority that items are awaiting payment of customs duties and taxes.

Tabehako is not responsible for import tax, custom tax, and other taxes charged by the local authority. All applicable customs and import duties and fees, taxes and any other charges are the responsibility of the customer, even if you refuse the shipment upon delivery. If your order does require these additional charges, they must be paid by you in order for your package to clear customs. Customs authorities require by law that we state the value of your order directly on the package. Customs agents have the right to release or deny release of your package and, in rare cases, they may also delay or reject delivery.

If you refuse to pay any additional fees, your package will be sent back to us. Tabehako will not process a refund in this case. Please ensure that you are aware of your local and/or national customs regulations before placing an order.

Except as may be explicitly permitted through this site, you agree not to sell, license, rent, lease, modify, distribute, copy, reproduce, publicly display, publish, transfer, edit, catalogue, aggregate, or create derivative works from discount codes received on or from this site. 

Registration data and certain other information about you are subject to our Privacy Policy. You understand that the technical processing and transmission of this Site may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Excluding any content which may be submitted by Members from time to time, we strive to ensure that the information on the Site is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies which we may correct without liability. We also reserve the right to limit quantities purchased by Members and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted and/or acknowledged). We do not guarantee that all products described on our Site will be available.

By sharing, submitting and uploading any of your data including but not limited to photographs, images, video, music, art, or comments, on this Site or via our social media channels, you grant Tabehako a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, prepare derivative works of, display and perform your user data in any legal manner for the benefit of MODATROVA. You acknowledge and agree that you are solely responsible for all the user data that you make available through Tabehako. Accordingly, you represent and warrant that: (1) you have all rights, licenses, consents and releases necessary to grant Tabehako the required rights to disseminate any user data, (2) neither your data nor your posting, uploading, publication, submission or transmittal of this data or Tabehako’s use of your uploaded data (or any portion thereof) on, through or by the means of Tabehako will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights or rights of publicity or privacy or result in the violation of any applicable law or regulation.

Except as otherwise specifically provided, the site and the products offered on the site are provided on as “as is” and “as available” basis without warranties or any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, Tabehako disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Tabehako does not represent or warrant that the functions contained on the site will be uninterrupted or error-free, that the defects will be corrected, or that the site or the server that makes the site available are free or viruses or other harmful components. Tabehako does not make any warrantees or representations regarding the use of the materials on the site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Applicable Law may not allow limitations or exclusions on warranties, so the above limitations may not apply to you.

The technology underlying, and the entire content included in, the Site, including but not limited to text, graphics or code is copyrighted as a collective work under The Netherlands and other copyright laws, and is the property of Tabehako and is protected by copyright and other intellectual property or proprietary rights. In an attempt to provide increased value to our visitors, Tabehako may link to sites operated by third parties. However, Tabehako has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Tabehako. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Tabehako seeks to protect the integrity of its Site and the links placed upon it and therefore requests any feedback on not only its own Site, but for sites it links to as well (including if a specific link does not work).

You agree to indemnify, defend, and hold harmless Tabehako, its officers, directors, employees, agents, licensors and suppliers from and against all losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms, or any activity related to use of the Site (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account.

Tabehako nor their celebrity spokespersons shall be liable for any indirect, incidental, special or consequential damages that result from the use of, or the inability to use, the site or materials on or provided through the site, even if Tabehako has been advised of the possibility of such damages. In no event will Tabehako’s liability to you exceed the amounts that you paid to Tabehako. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Tabehako shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Tabehako shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card/payment method charged. If your credit card/payment method has already been charged for the purchase and your order is canceled, Tabehako shall issue a credit to your credit card account in the amount of the charge. Tabehako has no liability for injury or damage caused by products within the box. Such liability is the sole responsibility of the product brand or manufacturer. These Terms of Service are applicable to you upon your accessing our Site. These Terms of Service, or any part of them, may be modified or terminated by Tabehako without notice at any time, for any reason. Tabehako reserves the right to limit discount codes to one per customer in its sole discretion. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous, shall in all events survive any termination of these Terms of Service and your use of our Site.

These Terms constitute the entire agreement between you and Tabehako with regard to your use of the Site. Neither the course of conduct between the parties nor trade practice shall act to modify any of these Terms. Tabehako may assign its rights and duties under this Agreement to any party at any time without notice to you.
